Not really sure if any of our members can assist with this but if the instrument is valued at what you say I suggest you consult a solicitor. The airline has advised you that the maximum compensation they are liable to pay is £800. Without specialist assistance then you are going to struggle. I assume you are a professional musician - in view of the value do you not carry insurance that covers for such things. With the restrictions that apply to luggage in these times then there is always the chance that restrictions may be applied without notice.

Whilst you may have told the check in desk what it says in the brochure, as far as I am aware the desks tend to be manned by handling agents and not direct airline employees. I doubt that there is anything she could have done as she only carries out the duties as defined by her supervisors.

I am a semi pro musician and i have additional cover on my household insurance and it covers me worldwide for my instruments. as long as they are in my possession - so being put in the hold made the cover void.

obviously my point is that it shouldnt have gone in the hold in the first place. I do understand that the check in satff are acting as agents for Thomas Cook Airlines however I still feel that TC are responsible.

I agree that the advie of a solicitor is probably the best way forward. My household insurance does however cover me for legal protection and I have made initial contact with them and theyhave suggested I try and claim first and then approach them for assistance.

So presumably the outward check in person said it was OK to take it? When was that?

TC are liable for both and one of them must have made a mistake. If you had been told on the way out that you couldn't take it in the cabin would you have travelled or would you have said the risk isn't worth it? If the return check in person was correct then the outward one got you into this mess.

As for the conditions you printed off, may have been better to save the whole page including source code to your hard disk but too late now. Was this a scheduled flight or a seat on a charter or part of a package as the conditions for the three might be different?

The bad news is that however morally right you are they will have an army of legal people to fight you and wear you down. TC took over Airtours a couple of years ago and Airtours alone had such a big legal dept it had it's own building! Don't expect to see any money before Christmas.

I don't think that will help. Recently my hand luggage was of an acceptable size at Alicante airport on Easyjet to Gatwick but too big at Gatwick for the return 2 days later :que

So did it grow or what? Their acceptable sizes are published so it should have been easy enough to prove one way or the other, preferably before reaching checkin.
