By "notary deed" you probably mean Notary Sale which transfers the ownership of the house to the new owner (before papers have returned from military).
Although the property deeds will be given to the new owner, they cannot be transferred into their name until the papers come back from the military dept.

Hi Ladyofleisure... a tapu is the most important document in Turkey when house buying.It should have your picture on it and the details of the property. Slap bang in the middle is the turkish crescent and the words TURKIYE CUMHURIYETI KAT MULKIYETI tapu senedi. The notor is the government body which witnesses transactions and will issue paperwork pertaining to your deals while the government authorities change the tapus from seller to buyer. I hope you have a lawyer and he/she should explain what is happening. :gluck

Can I just add that we are on a co-operative in Altinkum (which we knew about all along) and we have definetly got deeds/tapu for our house. We didn't pay any extra fees for solicitor than what was already covered in signing the contracts etc. So I really don't know what/where the problem is to be honest.

The interesting thing about all this is, I have also had a reply from the Turkish Embassy in London with all the In's and Out's of house purchase in Turkey, including a page on Co-Ops.

I have told the lady is selling this house all the advice I have had from this forum and also sent her a copy of the reply from the Turkish Embassy.

I had a reply the other day. The Tapu's should be issued next year !!!!!

Interesting in that there was no chance a few weeks ago !!!

can any one help me
if ur visa to turkey has run out whilst u are still there does this mean that you can get a fine or can u just go back to uk without renewing it

You will get fined and probably have a not very nice time with the police.
You also run the risk of not being allowed back into the country in the future.

Hi,
My visa ran out 5 days before we left Turkey this October. It goes on 90 days entry from first date u enter Turkey. I thought it was 90 days from the first date we left. My big mistake! Although when u enter Turkey they do not ask how long you intend staying, so none the wiser until we tried to leave.

Marched into Police office (they didnt speak a word of English) .
They charged a set fine of 60 mil then 10mil a day for every day you overstay. It worked out about
£110 ouch! for the 2 of us.
If we didnt pay, they give you a form to say you are banned from Turkey for 5 years (didnt help us as we have a property there). They said we could pay it when we reentered Turkey next year but thought it best to pay straight away as we didnt know if they would still add 10mil a day to the already hefty fine. We have recently visited Turkey and now are looking inti buying a villa in Kusadasi.
We have almost checked on every website for info on many properties.
If anyone has bought a property in Kusadasi, please could you advise of the Estate Agents.
We are looking for a reliable Estate Agent. There are many in TUrkey but don't know which one to go for.

If your buying a property in turkey, please stay away from co-operatives. Other than no deed, co-operative houses are relatively a low quality housing complex. Co-operative houses are not ment for foreigners if your looking for a deed.

We actually settled on Gumusluk. Gumsan 2 complex, and it is DELIGHTFUL !!!
Fabulous lady estate agent.

We are now thinking of Turkey permanent.

Lots more research now !

Bought the house, got the Tapu !
Got it renovated, and now we are renting it out.

Have to say that it was really worth all the trouble !

But thanks to this Forum for all the advise !

hiya i have heard some rubish and misconseptions about co-operatives in turkey i bought my first villa at onurkent (this co-operative was formed by high level turkish judges and solicitors) the first brit to do so over 10 years ago and it is by far the safest way to buy 1) you know the the building is legaly built 2( when the co-operative is finished by turkish law tapus must be issued 3) the members vote in a president every year and set the fee"s for the ensuing year and have a say in the running
I also was involved is selling villas to over 20 brits and irish in the area and would recomend the people buy from legally set up co-operatives as i have seen what has happened on sites that are not co-operatives ie a site near the airport and new golf course 440 houses built without planning permission

When i first came to gundogan it was still a fishing village and little else and have been instrumental in bringing many people to this beauiful part of turkey which is now the place to visit with many good hotels and restaurants and a family friendly place with virtually no crime no yobs cant say that for any town in the uk

i know the turkish system of house purchase and will offer my advise free of any charge to any brit who wants to buy in turkey
