Had you have been denied boarding at the airport by bmi then the fault would lie with bmi either due to downgrading of aircraft or operational reasons leading to reduced capacity- (not overbooking of an aircraft by tour operator, This being outside of the control of any charter airline,and the cause resting with the tour operator)

However on this occassion KOSMAR re aranged your flight arrangements therefore it to Kosmar that you should direct your request for compensation.

All charter carriers only carry the passangers who the tour operator manifests or tickets, In this case the Tour Operator amended your travel arrangements.

bmi operated the flight on its contracted aircraft in line with its legal obligations, Your tour operator amended your travel arangements for reasons that at present remain unclear.

Im sure that bmi would be happy to confirm that the flight operated in line with contracted capacity etc. contact details for bmi charter can be found else where on this site.
