A few questions so we can help as there appears to be two different issues firstly the room, which hotel? and what was your reason for your complaint?

The second issue appears to be that the rep appears to have treat you differently simply because you're disabled and this has of course upset you greatly. The second issue would be very difficult for me personally to advise you on as it appears to be a case of proving discrimination and I would suggest you contact Simpson Miller solicitors(contact details on this forum) to talk over that issue with them.

Hello Brian and welcome to HT. Like Stardust, I think that you have two different possible claims here and whilst I think that Simpson Miller could help you with the first holiday related problem re the hotel room I think that with regards to the treatment you received at the hands of the rep you need a lawyer that specialises in Disability/Discrimination law. The fact that she was employed by a TO is in many ways incidental to your situation - she wasn't breaking any holiday related laws but the Disability Rights and Discrimination laws.

It's no wonder that Thomson would like a copy of the recording - this is a potentially much more serious and damaging case for them that could cost them a lot more than just the average holiday compensation claim. You potentially have a case not just against the rep as an individual but also against Thomson as her employer. Under UK law they are supposed to not only provide staff training for their staff to ensure that the law is complied with but are also supposed to ensure that it is complied with and from the sound of it they are doing neither. Depending on the nature of your disability and/or your mental health condition I would suggest that you consult the appropriate campaigning or support charity - they will have a much better idea about whether you have a case that is worth taking to law and will also be in a better position to refer you to a lawyer with the appropriate experience. They might even be prepared to help you directly take the case to court via their own in-house lawyers if they think that this is an area where there is a need to establish case law re a TOs responsibilities with regard to their employees behaviour in resort and which court's jurisdiction applies.

I realise that you might not want to discuss the details of your situation on an open forum like this, so I will send you a pm which you can then reply to if you would like more information on which charity or support group to take this up with because as 'newbie' you won't be able to pm me first until you reach the threshold number of posts to the HT forums.

It.s funny that I went in to Thomson's were I booked, and after telling the asst Manager she cried about the way I was treated

bri good luck with everything, hope you get it all sorted out. I am disgusted at the way you were treated, some people are in the wrong job
