The reason it goes quiet when courts are mentioned is that there hasn't been any LASTING court judgements. I think three members have posted that they took the DE to court and won only for the DE to PAY the court to have the judgements set aside, for technical reasons. They then settled out of court offering our members cruises or cash.
Somehow, before you get to court, I expect they will do the same with you :)

I think that one or two people have had a satisfactory offer from the D E just BEFORE they were due in court. They will try to persuade you that you are not entitled to anything and then make an offer at the last minute. If they do this, and it's a cash ammount, you need to know how much you are prepared to take. i.e. How much will a cruise really cost, either for 2 people or for 1 plus single supplement. Know what you will be happy with or ask for time to consider their offer. They can hardly object to that when youv'e had to wait so long.

We have end of Januarry 2008 and I did not get my cruise offer. I complained to ASA, Trading Standars and received letter from DE that they sent me offer letter and I have not replay, so according to DE the subject is closed. I have NEVER received offer letter. Asked DE for the explanation or copy of thuis so called "offer letter" but no reply. I will take them to Small Claim Court now- shall I do it ??

Yes piesbari. First get in touch with Ros Ferneyhough the travel solicitor who acts for many HT members and, once you have her opinion, if she agrees you have a case, write to the DE saying you have taken legal advice and are taking them to court. That is the first couple of steps. After that you can join the rest of the (un)merry determined band of those on here going through the same process. How to contact Ros Ferneyhough ? please Iam sending a letter to Legal Department of DE giving them 14 days to replay, and then will go to inline Small Claims Court, if not will contact Ros and take them to court for the value of holiday, lost bargain and for tricking me with fictious offer letter in order to satisfy their obligation" Shall I do it this way ? Sorry, I spelt her name wrong, it's Ros Fernihough. She is a Travel Law Solicitor who can provide the best information available.
and offers HT members free impartial legal advice. She doesn't read HT but can be contacted on Tel:01922 621114. If you have a look at the 'Complaints' forum you will see quite a few people have been referred to her and she has proved very helpful.

I'm still waiting for my date for my court hearing. The DE are even trying to drag this process out by not completing required court documents in time and then being threatened with ruling in my favour unless they responded within 3 days.

My money is on them making an offer to settle out of court just before the date. You need to work out how much you are willing to settle for, or if you want a cruise as promised. A seven night cruise is approx £700 based on 2 sharing a cabin. Single supplements usually make the cost almost double that.

I have been looking at this thread for some time and am now about to take DE to court. But I do not know what to write on the court papers as regards why I am taking them to court. Does anyone know what legal terms ect I can use to state clearly what the problem is?

Go to Online Small Claim Courts first and on page 242 and 246 have a look somebody gave us a sample of what to write.

Hi , I complained to ASA and they told me that DE requested from ASA our names ( people who complained) and asked for my permission to forward my details to DE. I agreed. Few months later I received first ever letter from DE saying that "they are sorry that I could not accept they offer letter and for this reason they obligation is finished". I have Never received any offer letter.
I have a claim against DE in Small Claim Court Online , and waiting for the DE replay. Can you tell me about yours "never existing" offer letter ? I think I can also hold them responsible for deluding me with false letters. I asked for a copy of this letter but never got any replay. Write to me, please Alina

Hi All,

An update on my case, I now have a Court Date set so the end is drawing near I hope. Does anyone have a copy of BBC's Watchdog from a few years ago when they had The Daily Express's St*n Myers*n on admitting it had been badly handled and oversubscribed, but he guaranteed that all readers that applied would get a cruise in the end.
If anyone does have a copy of this please PM me. I am happy to pay for the copy to be made and posted.
